TERMS OF SERVICE
GSM dual-band handset required.
Wireless service is subject to credit approval.
Promotional Offerings require a new two-year service agreement.

Early Termination Fees: If service is terminated prior to completion of service agreement, a non-prorated $200 Early Termination Flat Fee applies.

Return Policy: If you have your receipt and your phone is returned within fourteen (14) days in like-new condition, with all components and packaging in the original box, (the phone must be undamaged and in new saleable condition) the early termination fee will be waived. All other charges apply. No cash refunds. Any refund due will be credited to your account or final bill.

Minute Increment Billing and Usage: Airtime and other measured usage are billed in full-minute increments, and actual airtime and usage are rounded up to the next full-minute at the end of each call for billing purposes. XIT Wireless charges a full-minute increment of usage for every fraction of the last minute used on each wireless call. Calls placed on networks served by other carriers may take longer to be processed, and billing for these calls may be delayed. Those minutes will be applied against your monthly minutes in the month in which the calls appear on your bill. Airtime charges apply from the time you press SEND to the time you press END. Unanswered outgoing calls will be billed for the incurred airtime. Prices are subject to change. Prices do not include taxes.

Activation Fee: A $35.00 Activation Fee is required for each new line.

Nights and Weekends: Nights and Weekends are from Monday through Thursday, 9 p.m. to 5:59 a.m. and Friday from 9 p.m. to Monday at 5:59 a.m.

Service Area and Usage: XIT Wireless reserves the right to terminate your service or change your rate plan, if less than 75% of your usage over 3-consecutive billing cycles, is not within XIT's 7,500 Square-Mile licensed area. Customers must (1) use a wireless GSM dual-band handset programmed with XIT’s preferred roaming database; (2) have a mailing address and live in the 7,500 square-mile Home Calling Area.

Removal of Features and Caller ID Blocking: Your wireless number on outbound calls will be displayed to other wireless and landline phones with Caller ID capability. Contact customer service for information on blocking the display of your number. There will be a $10.00 secondary service charge to remove any calling feature after initial activation of phone.


Mobile-to-Mobile Minutes: Mobile-to-Mobile Minutes may be used when directly dialing or receiving calls from any other XIT Wireless customer while within XIT’s 7,500 Square-Mile Home Calling Area. Mobile-to-Mobile minutes included in the plan only work between XIT customers.

Voice Mail: Customer is responsible for selecting Voice Mail password and keeping a copy of password in a safe location. In case of password loss, there will be a $5.00 charge to reset Voice Mail to the default setting.

FREE 5-State: XIT Wireless Free 5-State Long Distance area includes Texas, Oklahoma, Kansas, Colorado and New Mexico.

Service Coverage and Maps: XIT Wireless Coverage Maps depict an approximation of outdoor coverage. Maps may include areas served by unaffiliated carriers and may depict their licensed area rather than an approximation of the coverage there. Actual coverage area may differ substantially from map graphics, and coverage may be affected by such things as terrain, weather, foliage, buildings and other construction, signal strength, customer equipment and other factors. Home Calling Area, Regional Extended Calling Area, Regional Coverage Area, Nationwide Extended Calling Area and Nationwide Coverage Area are terms designated by XIT Wireless to define its calling areas for different
wireless plans and in no way indicate wireless coverage availability in all portions of the designated areas. We do not guarantee you uninterrupted service or coverage. Airtime and other service charges apply to all calls, including involuntarily terminated calls. We cannot assure you that if you place a 911 call you will be found.

Other Conditions: XIT does not guarantee availability of the network. Certain features will not be available in all areas at all times. In the event that the conditions of the Rate Plan as described above are violated, XIT Wireless may move subscriber to another calling plan or terminate customer’s service. XIT Wireless may change any terms, conditions, rates, fees, expenses, or charges regarding your service at any time. We will provide you with notice of such changes (other than changes to governmental fees, proportional charges for governmental mandates, roamer rates or administrative charges) either in your monthly bill or separately. XIT Wireless makes no warranty, expressed or implied, of merchantability or fitness for a particular purpose, suitability or performance regarding any services or goods herein offered. Other terms and conditions may apply. This Agreement, the signature or rate summary sheet, the terms included in the rate brochure(s) describing your plan and services, and any documents expressly referred to herein or therein, make up the complete agreement between you and XIT Wireless, and supersede any and all prior agreements and understandings relating to the subject matter of this Agreement.
